Statement of Commencement of Live Streaming

The Mayor made an announcement about live streaming requirements noting that:

Public Forums are recorded and live streamed to the Internet for public viewing.

The recording will be archived and made available on Council’s website www.begavalley.nsw.gov.au.

Acknowledgement of Traditional Custodians of Bega Valley Shire

The Mayor commenced by acknowledging, on behalf of Bega Valley Shire Council, the Traditional Custodians of the lands and waters of the Shire, the people of Yuin nation, to show respect to elders past and present.

In the lead up to the next election transparency will play an important part.
Council claims transparency yet in this instance have not provided the public with an opportunity to review, consider and comment.
That landowner and stakeholder impacts will vary as they examine the impacts of the proposed changes as it may pertain to property holding affected by the new classification/clauses.
That council’s approach seems inconsistent with amendments the LEP which follows a nine step process that includes, step 7 - Community Consultation
That the additional clauses may have financial and economic impacts beyond Council.
That this amendment be deferred until a new BVLEP can be developed in its entirety.

I am probably the oldest living land holder at Wonboyn Lake, whilst I reside in Melbourne, I spend a lot of time at my property on the South Side.

1.     I would like to register my concern of the short notice the BVSC has provided for decisions to be made on our Entrance Management Policy.

2.    
All options presented have been based on the assumption that Wonboyn Lake is Classified as an ICOLL.My understanding of an ICOLL is that the Entrance/Bar to the ocean is closed for 70% of it's time. Historically Wonboyn Lake has been closed for less than 2% of it's time. My understanding is that Wonboyn Lake is Classified as a Wave Barrier Entrance and should remain as such.

 

3.     I believe the BVSC would be better off in the long run to take a managed approach to our Entrance, i.e. make it permanently open and consistent with most other Estuaries in this Country

The Wonboyn Lake Ratepayers Association EMP subcommittee are generally supportive of the proposed BVSC Entrance Management Policy, however request the addition of the following:

1. Creation of a WLEC (Wonboyn Lake Entrance Committee) with annual meetings and annual reports to provide two-way feedback between Council and community regarding this complex system (members to include Council, Oyster farmers, and Wonboyn Lake Ratepayers Assoc. representative)

2. Agreed pathways through Council for the approval of higher or variable waterfront infrastructure

 

Item 8.3 Finalisation of Commercial Land Use Strategy Planning Proposal

Metro Planning Services has been engaged by Mr Brittliff who is the owner of Lot 411 DP 1138508, No. 1-7 Bega Street, Tathra, to prepare a submission to the Draft Commercial Land Strategy Planning Proposal.

We have reviewed the Draft Commercial Land Strategy Planning Proposal that in part seeks to rezone a number of properties located on the Tathra Headland from B2 Local Centre to B4 Mixed Use. Refer Figure 1.  The properties identified to be rezoned are located directly to the west of our client’s property however our client’s property is not currently identified as a site that is recommended to be rezoned.

Accordingly, our client requests Council to make an amendment to the Draft Commercial Land Strategy Planning proposal to rezone the northern vacant portion of the site to B4 Mixed Use to allow the opportunity for the site to be developed with a residential type of development permitted under the B4 Mixed Use zone without the requirement for a commercial/retail component.

The Staff Recommendation states that addressing the stormwater drainage issues in Imlay Street Merimbula is identified in Council's 4 year forward plan but does not provide any details as to when drainage works will actually commence in Imlay Street and then states that the construction phase can be scheduled for funding consideration in future annual budget cycles.  in other words I have no idea whatsoever when and if these essential works will ever be done by Council.  This is a most unsatisfactory answer to my submission.

I also could not find on the Council's website the Council's 4 year forward plan that is referred to in the officer's response to my submission.
